The Law on Promulgation of Legal Normative Documents 2025 (No. 64/2025/QH15), passed by the National Assembly on February 19, 2025, and effective from April 1, 2025, marks a significant step in improving the legal framework for the development and issuance of legal normative documents (LNDs) in Vietnam. This law aims to address institutional bottlenecks and ensure transparency, consistency, and feasibility within the legal system.
Key Highlights
🔹 Removal of commune-level authority to issue LNDs
The new law revokes the authority of People’s Councils and People’s Committees at the commune level to issue legal normative documents, reducing the number of authorized entities from 15 to 14. This change simplifies the legal system and helps eliminate overlaps in administrative management.
🔹 New form: Government’s legal normative resolutions
The law introduces a new form of LND, allowing the Government to issue resolutions to promptly address regulatory challenges and promote socio-economic development within its assigned functions and duties.
🔹 Policy consultation mechanism introduced
An important addition is the inclusion of policy consultation as a method for gathering public feedback. This ensures that drafting agencies collect input from citizens, businesses, and organizations, thereby enhancing the quality and feasibility of proposed legal documents.
🔹 Enhanced transparency and public participation
Drafting agencies are now required to publicize, respond to, and justify all feedback received during the drafting process. This promotes constitutional and legal compliance and ensures coherence within the broader legal system.
Legal and Social Impact
This law not only streamlines the legislative process but also acts as a catalyst for socio-economic development, the protection of human rights, gender equality, and alignment with international treaties to which Vietnam is a signatory.
By removing commune-level authority and encouraging policy consultation, the law brings the legal system closer to real-world needs and strengthens public participation in law-making.
